Vietnam accedes to the Madrid Protocol

Vietnam's accession to the Madrid Protocol will take effect on 11 July 2006. With this new development, with effect from the said date, applicants from Madrid Protocol countries, such as the United Kingdom and United States will be able to designate Vietnam in international applications based on national applications or registrations.

FEES

The official fees are set out below:

International application or subsequent designation

For one class of goods or services 155CHF
For each additional class 122CHF

Renewal

For one class of goods or services 139CHF
For each additional class 122CHF

Procedure

The procedure for filing the application simply involves designating Vietnam in an international application filed with WIPO. This is straightforward. However, from and during the national examination phase, the applicants may be required to reply to an office action initiated by the Vietnamese National Office of Intellectual Property. In that event, further prosecution of the case will have to be dealt with by a qualified Intellectual Property agent resident in Vietnam.

Vietnam's accession to the Madrid Protocol will create greater awareness with more companies seeking protection of trade marks in Vietnam.
