Thailand’s Department of Intellectual Property (DIP) issue a new “Fast Track System” for Trademark Registration and Trademark Renewal

As per the recent Department of Intellectual Property (DIP)’s Declaration, the DIP has announced a Fast Track system for (1) Trademark Registration and (2) Trademark Renewal (effective from 23th February 2021), which can be summarised as follows:

Trademark Registration Fast Track System– The usual timeframe for Trademark Registration as per the DIP Manual (as issued under the License Facilitation Act) is about 16 months. As per the DIP’s new Fast-Track Declaration, trademark applications that meet the two required conditions will automatically be reviewed (i.e. no additional request is required) under the new Trademark Registration Fast Track System which takes only “6 Months” (as opposed to 16 Months) to approve the trademark application. The two required conditions are as follows:

  1. The total number of goods/services must not exceed 30 items.
  2. Goods/services must be selected from the DIP Website.

Trademark Renewal Fast Track System– The usual timeframe for Trademark Renewal as per the DIP Manual (as issued under the License Facilitation Act) is between 3-6 months. As per the DIP’s new Fast-Track Declaration, the examination of Renewal Applications and grant of a Certificate of Renewal will now be completed within “45 minutes” (of a Renewal Application being filed with the DIP, and without additional Official Fee) provided that the Renewal Application meet the required conditions as follows:

  1. The total number of goods/services must not exceed 30 items.
  2. No changes have been made to the particulars of the trademark registration., i.e. change of name or address, re-classification of goods etc. will render the mark ineligible for fast tracking
  3. The Renewal Application must be filed at the DIP by either the (1) owner, (2) an appointed attorney (general or specific); whereby, in the latter case, the Power of Attorney (POA) must clearly authorise the attorney to (1) file the Renewal Application and (2) collect the Certificate of Renewal on the owner’s behalf.
  4. Fast Track examination must be requested with the DIP Officer at the time of filing the Renewal Application.
  5. All the required Official Fees of the Renewal Application are fully paid.
